1. Summary and objective

 

Welcome to the www.andrersanches.com website, applications and associated services (“Site”). This document ("Terms") sets forth the applicable terms and conditions​​ to the use of the website. Please read the terms of use carefully before using the Site. When accessing, browsing or using the Site ("Use"), all users and visitors ("You",  “You”, “User” or “Users”) declare that they accept the terms and conditions contained in these Terms. If you do not agree with the terms and conditions contained in these terms of use, please refrain from using the Site.

By using the Community, you agree to the Community Terms and Conditions (“Community Terms”), Terms of Use , Privacy Policy and any other Code or Policy that apply (“Terms”).

 

These terms constitute a legally binding contract between you and Andre Sanches Mentor, Coach, Speaker, Adviser of Mindset and Agile Culture and its subsidiaries/affiliates/group companies (“Company”, “Company”, “Group”), so please read them carefully. If you don't agree with the terms, please avoid using the community. Some of the terms, such as company used in the community terms, are defined in the company's terms of use.

2. Community account

 

To use the community, you must have an account on the site, following the instructions on the registration page. You must ensure that your registration information is true, accurate, complete and up to date.

It is strictly prohibited to include in your profile any information that suggests that you are an employee or moderator of the company, or that you are acting as an employee or moderator when using the community.

3. No official support

 

Information, advice or other material of any kind published in the community (“Content”) is not official support provided by the company. For official support, use the  Institutional Contacts . You acknowledge that opinions expressed in community content are the sole responsibility of contributors to that content and do not reflect the opinions or policies of the company.

4. Content, moderation and reporting

 

You are responsible for all content that you post to the community. The company does not control or assume responsibility for this content or any content posted by other users.

 

The company reserves the right to moderate activity in the community and remove or edit any content for any reason or no reason, including, without limitation, content that, in its sole discretion, violates the community terms. The company may remove or edit this content without prior notification to the responsible user.

 

Please note that community use in conflict with any of the Terms may result in the immediate cancellation or suspension of your accounts (see term and termination section  below).

Help the company protect the integrity of the community and ensure the community remains as helpful as possible by reporting any inappropriate activity or user posts in the community. Inappropriate content or activity may be reported through the  Institutional Contacts .

5. Guidelines

 

The integrity and security of our community and our users means a lot to us. To keep the community as efficient and helpful as possible, we hope you'll adhere to our guidelines.

6. Reward programs

 

Community resources may include a reward system(s) whereby the company, in its sole discretion, may reward users based on their overall contribution to the community. You acknowledge that the Company's decision on any reward will be final and binding. The company may change or remove the reward system at its discretion from time to time.

7. Limited license

 

You grant the company a worldwide, non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, make publicly available, publish, translate, create derivative works, and distribute any content or feedback you post or provide through the community and to exercise all copyright and publicity rights with respect to such content or feedback, without any attribution to you.

8. Term and termination

 

These terms will take effect when you create a Company Community Account and will remain in effect until you close your Company Community account or until terminated by the Company.

You can close your community account at any time by contacting the company. Without limiting your other rights to terminate Community access, Company reserves the right to terminate or suspend your Community Account at any time if, in Company's sole discretion, you breach any of the Terms. If,  at the sole discretion of the company,  if the company terminates or suspends your community account for any reason, it will have no obligation or liability to you. Please note that if your community account is terminated by you or the company for any reason, the content you have posted may be kept in the community anonymously.

9. No warranty

 

Use of the community is at your own risk. The community is provided “as is” and “as available”. To the fullest extent permitted by applicable law, the company makes no warranty, express or implied, as to the quality, content and availability or fitness for a specific purpose of the community. Furthermore, the company does not guarantee, endorse or assume responsibility for any content published in the community or on the linked site. As with any information or advice obtained by any means or in any environment, you should use your best judgment and exercise caution where appropriate. No oral or written advice or information obtained by you from the company or any other company in the group shall create any warranty on behalf of the company in this regard.

10. Limitation of Liability

 

Under no circumstances shall the Company, its officers, directors, employees, licensors of group companies or third parties be liable​​ for any direct, indirect, incidental, special or consequential damages (including, but not limited to, loss of data, interruption of services, technological failures or financial losses) resulting from your use or inability to use the community, even if you have informed the company about the possibility of such losses and any damages resulting therefrom. Your only right in relation to any problem or dissatisfaction with the community is to terminate your account as set out above and stop using the community. Nothing in these terms removes or limits the company's liability for fraudulent misrepresentation, death or personal injury caused.​​ for negligence.

11. Indemnity

 

You agree to indemnify and hold the company, the group and its officers, directors, employees and licensors innocent of any claim or demand (including but not limited to fair legal fees) made by third parties due to, as a result of or related to a violation of the community's terms or guidelines or your violation of any laws, regulations or third-party rights.

12. Intellectual property

 

The company respects intellectual property rights and expects you to do the same. Please note that the community is owned by the company, group companies or their licensors and is protected by intellectual property rights (which include but are not limited to copyright) and that you do not have the right to use the community in any way not covered by these community terms.

13. Technological evolutions

The company will make every effort to keep the community in operation. However, some technical or maintenance issues may, from time to time, result in temporary outages. The company reserves the right, at any time and from time to time, to modify or discontinue, temporarily or permanently, the community or any of its features and functions, with or without notice. If the company changes or discontinues the community for any of the reasons mentioned above, the company or any other company in the group will have no obligation or liability to you.

14. Privacy

 

When you sign up to use the community, the company and its hosting providers may collect, store, share and use your personal data. The privacy and security of your user data is and will continue to be the company's highest priority. 15. General provisions

The company may assign its rights and obligations in connection with the terms, without restriction. You may not transfer your rights or obligations in connection with the Community or the Community Account, or any part thereof, to any third party. Any dispute, controversy or claim arising out of or relating to the community terms and guidelines shall be subject to the non-exclusive jurisdiction of the court or other court closest to your home that has adequate knowledge and experience to deal with such dispute, controversy or claim.

The company reserves  the right to update the terms from time to time in its sole discretion. You should periodically review it for any updates and modifications.

If these terms are translated into other languages and there is a discrepancy between the versions, the Portuguese (Brazil) version will prevail.
